Part-time workers are entitled to the same statutory rights as full-time workers under the Part-Time Workers (Prevention of Less Favourable Treatment) Regulations.
Part-time workers must be treated at least as well as the equivalent full-time workers, unless the reason can be objectively justified by the employer. An equivalent worker is someone doing a similar job on the same type of contract.
This means a part-time worker should:
receive the same rates of pay;
not be excluded from training simply because they work part-time;
receive holiday entitlement pro-rata to comparable full-timers;
have any career break schemes, contractual maternity leave and parental leave made available to them in the same way as for full-time workers; and
not be treated less favourably when workers are selected for redundancy.
The regulations include temporary staff such as agency and casual workers but part-time agency workers can?t compare themselves to full-time permanent workers.
